These Terms of Service ("Terms") govern your use of the internet services provided by Nighthawk Networking ("we," "us," or "our"). By using our services, you agree to these Terms.
We provide residential and business internet service in Grant County, Washington, over fiber-optic infrastructure operated by the Grant County Public Utility District (Grant PUD). Our prices are the same throughout Grant County; there are no location-based price differences within the county. Service at a specific address is subject to confirming that Grant PUD fiber is available at that address. Speeds are provided on a best-effort basis and may vary based on network conditions and other factors.
Installation timing depends on the Grant PUD infrastructure at your address, which is outside our control. If a Grant PUD gateway is already installed at your address, installation can generally be completed within about 5 days, depending on how quickly Grant PUD makes an active port available to us. If your address does not have a gateway installed, Grant PUD must install one, which can take approximately 4 to 6 business weeks. These timeframes depend entirely on Grant PUD's infrastructure and scheduling, and are not within our control.
You are responsible for the charges on your account, including installation, equipment, and monthly service fees. Monthly service is billed in advance. If a payment is late or fails, we may suspend service until the account is current. Please contact us promptly if you believe a charge is incorrect.
We do not provide, rent, or lease equipment. You are responsible for having your own equipment (such as a router) ready and compatible for your installation. If you do not have the equipment you need, you may purchase it from us, subject to our stock availability; equipment you purchase from us is yours. You are responsible for the equipment you use with the service, including equipment purchased from us once it has been delivered to you.
You agree not to use the service for unlawful purposes, to interfere with the network or other customers' service, to resell the service without our written permission, or to send spam or other abusive traffic. We may suspend or terminate service for violations of this section.
Installation and repair visits are scheduled in advance. An adult should be present during the visit. We may need access to your premises and equipment to install or repair service. Appointment times are estimates and may change due to weather, emergencies, or other circumstances beyond our control; if that happens, we will contact you to reschedule.
If you communicate with us by text message, or schedule an appointment after being told we may text you about it, you agree to receive text messages from Nighthawk Networking related to your service and appointments on our support line, (509) 400-5198. Message frequency varies depending on your support case. Message and data rates may apply. You can opt out at any time by replying STOP, and get help by replying HELP. Consent to receive text messages is not a condition of purchasing any service. Wireless carriers are not liable for delayed or undelivered messages.
We work to keep the service running, but interruptions can occur due to maintenance, outages, weather, or causes beyond our control. To the fullest extent permitted by law, our liability for any claim related to the service is limited to the amount you paid us for the month in which the issue occurred, and we are not liable for indirect or consequential damages.
We may update these Terms from time to time. The current version will be posted on this page, and continued use of the service after a change means you accept the updated Terms.
